There were apologies from Councillor Dawson. The reasons were accepted. Councillor There were no declarations of interest.

MINUTES OF THE MEETING HELD ON 20 FEBRUARY 2013

Minutes with some amendments were agreed and signed as a correct record. Councillor Swainson declared a pecuniary interest in item 13/42/b.

CLERK’S REPORT & MATTERS ARISING

The Chairman had cut back the alder tree at Millers Bridge. A volunteer was now required to remove or dispose of the branches.

Alan Scargill had visited the parish and the dog waste and rubbish had been removed.

It was agreed to hold a meeting between SPFA, the Clerk and Councillor Wilson on 17 April 2013 at 6.30pm in the village hall. Councillor Seymour explained that Stokesley playing field is managed by the Parish Council and this allows them to reclaim the VAT and employ a caretaker. However the lack of charitable status can be a disadvantage when applying for grants.

PLANNING APPLICATIONS FOR CONSIDERATION

NYM/2013/0097/CLE – Application for certificate of lawfulness for construction of dwelling and garage in excess of 4 years and use of land for domestic purposes in excess of ten years at Sycamores, Faceby for Mr & Mrs Thomas Jackson. No comment.

NYM/2013/0107/FL – Application in respect of variation of condition 4 of planning approval NYM/2006/0374/FL to allow the occupancy of the letting unit by person(s) living/working in neighbouring parishes at Fairville, Heathwaite, Swainby for Mr Graham Swainson. Without Councillor Swainson there was not a quorum to consider this matter.

COUNTY COUNCILLOR REPORT

Councillor Seymour reported that there had been a nil increase in the council tax and it was a struggle to keep services going. The situation with pot holes was not improving.

DISTRICT COUNCILLOR REPORT

Councillor Hugill reported that there had been thefts from Ox Hill Farm including a seed drill and power washer and a request had been made to gate the road for security reasons. Councillor Seymour confirmed that this would require a formal closure notice and that road was planned to be used for the cycleway.

Councillor Hugill would liaise with PC Skelton and Farm Watch over the matter. The glider station on Carlton Bank was in the process of being removed.

The Community Infrastructure Levy consultation had ended and would now be considered. There would be no CIL in the National Park at the moment.

CLERK’S REPORT & MATTERS ARISING

NYCC had agreed to send an officer to give a presentation at the Parish Assembly in May on Emergency Planning. Councillors Cole and Johnson would arrange the refreshments. The upstairs of the hall was booked.

The Alder tree had not yet been cut at Millers Bridge and it was agreed that two of the four stems be cut back to the root to encourage grass growth. Councillor Swainson would organise this and ask Andrew Lawton if he could assist.

POLICE REPORT

A report from PC Catherine Skelton had not been received. A surgery had been held in the village last week during the snow. A car had been stolen and two sheds and the Old Vicarage broken into. Warnings of a man selling cheap tools door to door from a Landrover had been given.

DOG FOULING

   

The Clerk has been unable to arrange for an officer from Hambleton DC Streetscene to

   

visit regarding dog fouling. He would contact Alan Scargill to see if he could assist.

13/27 PLAYING FIELDS

Mick Hannon spoke on behalf of the trustees of Swainby Playing Fields Association. He thanked the Parish Council for their support over the last few years. The Trustees are concerned about the personal liability which has fallen on some Trustees in other villages around the country. Many Trustees of other organisations have been resigning and it with this in mind and the ambitious projects for the playing fields that the Trustees would like to explore the idea of the Parish Council taking on the responsibility of the playing fields and a friends group managing it. The Clerk reported that he had supplied all relevant documents to YLCA for advice and they were now waiting for which proposal to explore. It was agreed that Councillor Wilson, Mick Hannon and the Clerk receive the advice from YLCA and see whether it would be feasible.

13/28 CHURCH LANE

An email had been received from a member of the public regarding the flooding in Church Lane. Contractors had cleared out the drain at the end of the track between Beech Dene and the Vicarage and it was hoped that this would allow the water to the beck in future. Mr Muckle was also taking action in his field to reduce the risk of flooding.

13/29 COMMUNITY INFRASTRUCTURE LEVY

The consultation by Hambleton DC regarding the proposed CIL was noted.

13/30 COMMUNITY FORUM

The proposed NYMNPA social media forum in October was noted. No members would be volunteering to help deliver it.

13/31 FINANCIAL MATTERS

  1. The attached payments were agreed.

  2. The verbal report from the Treasurer was noted together with balances of £8,833 in the public toilet fund and £1,094 in the general purposes fund.

  3. The public toilet water supply direct debit had been set up.

13/33 COUNTY COUNCILLOR REPORT

Councillor Seymour was not present.

13/34 DISTRICT COUNCILLOR REPORT

Councillor Hugill reported that there would be no change in the Council Tax this year and Hambleton DC remained the third lowest district council tax in the country.

A talk on the new Police & Crime Panel had been given which will scrutinise the new Police

& Crime Commissioner. They will also have to agree appointments of new Chief Constables.

Councillor Hugill had taken the lady recently knocked off her bike to see The Rt Hon William Hague to discuss the importance of a cycleway. He is going to write to NYCC about the matter.

13/144 MINUTES OF THE MEETING HELD ON 18 SEPTEMBER 2013
The minutes were agreed and signed as a correct record.
13/145 PUBLIC FORUM
Concern was expressed regarding the planning application from BT to erect a pole to deliver a line to the church office, it was felt that due this cable should be underground especially as money had been spent undergrounding many cables in the village.
A second hand pump is available from the fires service which would pump water in the case of flooding. The Clerk would be provided with more information and this would be put on the next agenda for consideration.
13/146 CLERK’S REPORT & MATTERS ARISING
a. The beck side fence had still not been repaired. NYCC Highways had apologised for the delay.
b. The stone bridge had still not been repaired. NYCC Highways had apologised for the delay.
c. The Clerk had arranged for a notice asking for volunteers to produce an emergency plan to be in the next Church newsletter.
d. The 30mph zone on Black Horse Lane had now been extended and buses were travelling slower.
e. NYCC would not remove the stones from Millers Bridge and had said that the riparian rights owners should be approached. The Clerk would ask NYCC who the landowners are.
13/147 PLANNING APPLICATIONS FOR CONSIDERATION
a. NYM/2013/0667/FL – Application in respect of construction of single storey extension at Bramble Byre, 3 Black Horse Court, Swainby for Mr Anthony Sutcliffe. No objections.
b. NYM/2013/0655/TN – Application for erection of 1 no. wooden pole opposite 74 High Street, Swainby for British Telecom / Openreach. Wish to see refused. The cable should
be underground as money had been spent undergrounding other cables in the village. Alternatively, it might be possible to run the cable from the existing pole in front of the shop, though the path is rather obstructed by trees.

13/149 POLICE REPORT
A written report had not been received from PC Skelton.
13/150 HANDOVER OF PLAYING FIELD
a. It was agreed that the Clerk should ask for two amendments to the draft lease relating to the ability of the Parish Council to add additional play equipment and to make the lease 20 years in length. Once this was done it would be sent to Andrew Jones, a solicitor who had kindly volunteered to look at it on a pro bono basis.
b. Councillor Wilson read out a report regarding the present state of fundraising by SPFA. They had secured £22,000 of funding so far with promises of more. A plant a tree day would be organised for December as 420 trees had been donated by the Woodland Trust. The next project would be to provide a shelter. Councillor Wilson thanked the Treasurer for his work on the VAT matters.
13/151 CHURCHYARD
It was agreed that a grant of £475 be made to Whorlton Parochial Church Council.
13/152 STANDING ORDERS
YLCA had released a set of model standing orders a few days ago so it was agreed to postpone the item until next month.
13/153 FINANCIAL MATTERS
a. A list of the payments authorised is attached.
b. A written report from the Treasurer had been circulated and it was agreed to pay J Beadle £1,000 in respect of grass cutting for the year to November 2013, a grant of £550 to Swainby Village Hall and £500 to B Kitching in respect of the cleaning of the public toliets from December 2012 to May 2013 and £500 to J Beadle in respect of cleaning the public toilets from June.
c. The report from the external auditor, previously circulated, was noted.
d. A remittance advice for the receipt of the half yearly precept of £4,700 had been received.
e. The setting up of direct debits to pay the Scottish Hydro Electric and the Information Commission were agreed.

District Councillor Hugill reported that the Hambleton Sports Awards had taken place and the school had won Junior Team of the Year and Jake Brown had received an award for canoeing.
The National Park community forum had taken place and there had been a discussion about using social media and a presentation from a mobile ‘phone provider which sets up
