15/185PUBLIC FORUM

Swainby & Potto WI representatives where here to present the village with its centenary gift of a wheelchair. This had temporarily been stored upstairs at the village hall. Discussions

will take place with the village hall committee to decide a permanent place for its storage.

The Parish Councillors thanked the WI for their gift.

15/186MATTERS ARISING FROM THE MINUTES

15/187INGLEBY ESTATES/PUBLIC ACCESS

Head Keeper David Cooke did not return to the Parish Council meeting and Cllr Wright felt that matters had probably been resolved during Mr Cooke’s conversation with the Bike Hire shop. This matter to be removed from future agenda’s unless approached by Ingleby Estates.

15/188 CLERKS REPORT

Clerk confirmed time had been spent with Simon Gibbon to take over the administration of the village website.

HDC changes to mini-recycling centres read out and noted.

NYCC assets sponsorship noted. Confirmed Swainby does not have any historical sponsorships.

Standing Orders still in circulation folder, deferred until the January meeting.

15/190PLANNING APPLICATIONS FOR CONSIDERATION

15/02382/FUL Change of use of existing stables to provide canine day care centre and

15/191PLANNING DECISIONS AND APPEAL

None received.

15/192EMERGENCY PLAN

Parish Councillors had been asked to suggest other contacts for the Emergency Team. Cllr. Foster had suggested Bill Hogg, Cllr Hannon suggested Jim Young & Cllr. Wright suggested Gary Hawthorne, all to be contacted to confirm their agreement to be added to the plan.

15/193BIRD MOUTH FENCING

Graham Prior’s appraisal report was discussed at length. Cllr Foster & Wilson had sent comments and these were taken into account. It was agreed that Cllr Hannon would meet with NYMNPA & Highways to discuss the plans and following this meeting the plans would be displayed in the Village Hall for public viewing. The Parish Council would make recommendations and listen to the views/comments of Swainby residents.

15/194TREES OVERGROWN

The training day has still to be organised. A report of the need to cut back the Willow Tree Church lane/Playing Field had been received and this would be looked at along with other trees previously reported.

15/195POLICE REPORT

Only one incident at Whorlton Castle reported and noted.

15/196PLAYING FIELDS

Cllr Foster & Wilson were not present and updates regarding the ROSPA report repairs

would be given at the January meeting.

Clerk returned the refund from the YLCA for the ROSPA course which had been cancelled.

15/197BONFIRE NIGHT

Cllr Foster had sent a report that the Bonfire Night had been successful and he would give a full report at the January meeting.

15/199DRAFT BUDGET/PRECEPT

The draft budget information had been circulated. Discussion took place regarding estimated

reserves available at the start of the 2016 financial year. Expenditure was forecast to be much higher in the 2016/17 financial year due to repairs/work required on the beck side fencing and trees which were soon to be inspected. Full Council agreed to raise the precept for the financial year 2016/17 to £8500.

Grants to the PCC & Village Hall agreed for the year 2016/17. The PCC to be asked for a breakdown of the accounts to show churchyard upkeep only.

15/200CORRESPONDENCE

All correspondence had been included within the agenda.

15/201COUNTY COUNCILLOR REPORT

Cllr Griffiths had attended a presentation by Trading Standards which had been extremely worthwhile and had discussed current scams which had seen many people lose large amounts of money.

Devolution – still no decision.

Locality Budget Grant, Cllr Griffiths will make an application for a small amount towards any costs in providing a defibrillator for the village.

Nigel Knapton had advised the Clerk of funding available from the British Heart Foundation for a free defibrillator. It was agreed that Clerk would apply for one and Cllr Griffiths would apply for funding if required towards training etc.

15/202DISTRICT COUNCILLOR REPORT

HDC remains the lowest 2 tier authority for Council Tax.

Cllr Hugill is concerned at the amount of planning applications for housing which are being passed. There appears to be a policy making it easier to build houses. Although he recognises there is a need for housing. Stokesley have permission for affordable housing.

15/44            MATTERS ARISING FROM THE MINUTES

  1. The next newsletter had been printed and copies were distributed for delivery.
  2. A speed concern form had been submitted to the Community Safety Partnership. NYCC Highways had still not responded and Cllr Griffiths would follow this up with Jane Charlton.
  3. The verge damage in Garbutt Lane & Heather Close was now not taking place, this would be monitored in the future.

15/45            CLERK’S REPORT

  1. The Chairman had done a walk of the village with Carol Cook and identified assets thought to belong to the Parish Council. These had been identified on a map.
  2. It had been confirmed that a presentation regarding the emergency plan would take place at the Parish Assembly. Also the Headteacher of the school would give a presentation.
  3. The Clerk distributed election packs to members. Further packs could be obtained direct from Hambleton DC.
  4. The provisions of the Commons Act 2006 and the subsequent consultation were noted.

15/46            PLANNING APPLICATIONS FOR CONSIDERATION

  1. NYM/2015/108/FL – Application in respect of variation of condition 1 of planning approval NYM/2014/0418/FL to allow a further 12 months to complete the works to the stoned hard standing at The Barn, Whorlton, Swainby for Mr Howard Tribick. The Council objects to this application and wish to see it refused. The applicant should carry out the works immediately.

15/47            PLANNING DECISIONS & APPEALS

None received.

15/48            FENCING

The removal of the bird mouth fencing along the beck side where it was not in use for safety purposes or to prevent cars from encroaching was considered, the removed fencing would be used to repair the remaining. This would be subject to the agreement of the insurers. Cllr Wilson would obtain quotations for the repair works and a decision would be made when all the information was received.

15/49            NYMNPA PARISH COUNCIL APPOINTMENTS

The election timetable for the appointments was noted

15/50            BECK SIDE

Permission to undertake works on the beck side to prevent further erosion of a garden was considered. It was not clear as to whether the Council was the legal owner of the beck side and could give such permission. Evidence regarding correspondence with the fishing club in the 1960s and a byelaw from 2000 would be submitted to YLCA for their advice.

15/51            POLICE REPORT

The monthly police report had not been received and the police were not present.

15/52            PLAYING FIELDS

There was nothing to report this month.

15/53            FINANCIAL MATTERS

  1. The attached payments were agreed
  2. The Treasurer gave the balances and spoke about the most recent VAT claim.

15/54            CORRESPONDENCE

15/55            COUNTY COUNCILLOR REPORT

Councillor Griffiths had nothing to report.

15/56            DISTRICT COUNCILLOR REPORT

Councillor Hugill reported that the new recycling collection contract would enable all plastics and tins to be comingled in a new black bin with blue lid. Provision would be made for those unable to accommodate a new bin. Glass would be collected in the blue boxes.

The Community Awards would take place tomorrow night at 7pm.

15/60   ELECTION OF CHAIRMAN

            Dolly Hannon was proposed by Simon Foster and seconded by Paul Wilson.

15/68   CLERK’S REPORT

  1. Clerks Contract of Employment circulated, agreed and signed by The Chairman.
  2. 2.Election payment of £100 to be paid in full by the end of August.
  3. Hambleton Parish Liaison Meeting, invitation for 2 representatives. Cllrs unable to attend. Clerk will be attending and will report at the next meeting.
  4. Toilets – Jem has requested another sanitary bin be placed in 2nd cubicle.

Clerk confirmed cost with Initial. £23.50 per year. Parish Council agreed that Clerk should place an order for this extra bin.

  1. Dog Bin Shepherds Hill. A communication misunderstanding meant that this box would not be replaced by HDC. The cost of a new bin is £372.18. Cllr Foster will check how many Dog Bins are currently in the village as it may be possible to re-site bins rather than purchase a new one.

15/69         SPEEDING CONCERNS – SWAINBY HIGH STREET.   

Data logger information noted. Children’s playing sign requested for Entrance to playing field. Clerk to chase.

15/70         PARISH COUNCIL INSURANCE POLICY

Increase in this year’s policy due to Playing Field equipment added and Jem as an employee. Present premium £757. Cllr Foster feels this is an acceptable figure. Policy accepted. Cheque written for payment at the end of meeting. Clerk to hold payment until part payment received from SPFA.

15/71         PLANNING APPLICATIONS FOR CONSIDERATION

                       None.

15/72         PLANNING DECISIONS & APPEALS

None received.

     15/73         BECK SIDE

            Mr & Mrs Atkins would like to undertake work to prevent further erosion of their garden at the

            Beck side. Whorlton Parish Council accept ownership of the Beck side and will write to Mr

            & Mrs Atkins to grant them access to pursue the works. The Parish Council would like to see

            a scheme of proposed work prior to this commencing. Clerk/Chairman to send a letter.

15/74   DEFIBRILLATOR

Clerk to investigate if there are any free defibrillators available. **

15/75   PLAYING FIELDS

Report from last SPFA meeting on 26th March 2015.

  • Repair work to entrance carried out with volunteers.
  • Entrance Way sign now complete.
  • Now have second Goal posts.
  • Funding applications being made for wooden shelter/bike rack/bin.
  • BMX Track maintenance work completed.
  • Coming events: Bike Ride & Barbecue 13th June, Sports day & Garden Party 11th July.

Need to appoint someone to carry out weekly inspection of Play Area. ROSPA Course available. Cllr Foster will discuss this at the next SPFA meeting and report back to the Parish Council.

15/76   BIRD MOUTH FENCING

Cllr Hannon had put together a Statement regarding options available to take matters forward. Statement circulated. Open discussion followed. Option B: agreed.

15/77   POLICE REPORT

            Report received from PC 1837 Lindsay Kyle. Read out by Clerk.

15/78   FINANCIAL MATTERS

            Parish Council Meetings.

            taken place when Treasurer returns from holiday 6th July 2015.

15/79   CORRESPONDENCE

A list of correspondence was circulated. Councillor Hannon had received an anonymous

letter requesting signs be put up asking visitors to the village to park considerately. Unable to take this matter further due to anonymity of writer.

15/80   COUNTY COUNCILLOR REPORT

Councillor Griffiths not present.

15/81   DISTRICT COUNCILLOR REPORT

Councillor Hugill reported that it was good to be re-elected. The turnout had been 73%. Cllr Hugill now has 8 Parish Councils and there are 28 members instead of 44.

The AGM is next Tuesday 26th May.

There will be a change in the handling of Planning Applications. Officers will be able to make decisions in some cases and there will be a need to be aware that nothing is slipping through the net.

To save money Councillors will be going paperless.

Bullamore has a Wind Farm proposal.

Cllr Hannon asked about the chance of a free Defibrillator and Cllr Hugill stated John Darley was the right person to speak to at NHS Hambleton, Richmondshire & Whitby. Clerk to

Contact Mr Darley. **

15/87   MATTERS ARISING FROM THE MINUTES

15/88   CLERK’S REPORT

  1. Parish Council received employers update from the Pension Regulator
  2. b.YLCA recommendation to adopt policy for effective management of recording at Parish Council Meetings. Policy Adopted. Clerk to notify the public of their right to

record Parish Council Meetings with a note on all future agenda’s.

15/89   CO-OPTION

There has been no firm interest from any parties wishing to be co-opted onto the Parish Council. Councillor Hannon states one gentleman may be interested, he is though away at this time. Clerk to enquire of the electoral and licensing manager for HDC if more time can be allowed for the co-option and the possibility of Whorlton Parish Council continuing with only 4 Councillors.   

15/90   PARISH COUNCIL WEBSITE

www.swainby.org has been offline for some time. Councillor Foster will speak to Simon Gibbon who maintains the site.   Councillor Wilson will speak with his website providers regarding costs and establishing a new website for the Parish Council.

            15/91   PLANNING APPLICATIONS FOR CONSIDERATION  

  1. 15/01072/FUL Change of use of part of the site to self-storage facility, remainder of site to remain as general storage for building company. Mr J Swales. No objections.
  2. NYM/2015/0362/FL Conversion of and extension to buildings to form 1 no, local needs letting dwelling with associated access and landscaping works at Mill Farm, Scugdale Road, Swainby. Mr S Cash. No objections.

15/92   PLANNING DECISIONS & APPEALS

None received.

            15/93BECK SIDE

An update had been circulated by Councillor Hannon. Mr & Mrs Atkins had replied to the letter sent out by the Clerk. The confirmed work on the beck side would begin on 6th July, would last for 2 to 3 weeks and there would be no disruption to traffic.

Councillor Hannon will ask Mr & Mrs Atkins for an outline of the work to be carried out.

 

15/94   OVERGROWN TREES BECK SIDE/HIGH STREET

Councillor Foster reported that the cutting back of these trees had already taken place and thanks should be made to Bill Hogg who had carried out this work. It was agreed that a vote of thanks should be recorded to Mr Hogg.

15/95   BIRD MOUTH FENCING

An email had been sent to Amy Ellis of Area2 to suggest a site meeting was necessary to progress matters. Councillor Hannon is still waiting for a response and will chase this when she returns from holiday on 24th June. It was agreed no work would commence on the fencing until further information was available from Amy Ellis.

15/96   DOG WASTE BIN

Councillor Foster reported that there are several bins at one end of the village and he will investigate the possibility of moving one of these to replace the stolen bin at Shepherds Hill.

15/97   DEFIBRILLATOR

No free defibrillators are available at this time and it was agreed that via the Newsletter residents would be asked if they would like to contribute to the purchase of a defibrillator. Cost of a new defibrillator is £1600.

15/98   PLAYING FIELDS

 

  1. Proposal for Children’s Playing signs from NYCC was discussed. It was agreed to accept the proposal and the positioning of the signs. Clerk to advise Area2.
  1. b.Copy of latest minutes received and attached. Councillor Foster gave an update of the accounts. Current balance noted. Councillor Foster asked if accounts reports could be quarterly.

Councillor Wilson reported on a successful Bike Ride of some 30 people and 70 attending the Barbecue which raised a net profit of £260.72.

Sonia Hawthorne will continue with the weekly safety inspection.

Councillor Wilson will ask Sonia if she would like to attend a half day H&S course for inspecting Play parks.

  1. Councillor Foster requested Clerk investigate the possibility of a Byelaw being approved to stop dogs and campers being allowed onto the Playing Fields.

15/99   NEWSLETTER

The draft copy of the newsletter was discussed. In relation to the item regarding the fencing, it was agreed to add ‘maintaining and/or removal’. The profile for this edition will be Councillor Foster.

15/100POLICE REPORT

            None received at time of the meeting.

15/101EMERGENCY PLAN

Paul Wilson to approach Stuart Kerr to ascertain if he would lead this team. Jim young has volunteered to join the team.

15/104COUNTY COUNCILLOR REPORT

No County Councillor Present.

 

15/105DISTRICT COUNCILLOR REPORT

Councillor Hugill reported that HDC now have the key to the Prison.

The HDC community grant ‘Making a difference’ of £25,000 was awarded to 3 applications from the Stokesley Regeneration group which has helped drive matters forward. The parish liaison meeting was successful with many Parish Councillors representing their districts.

A talk on the waste strategy took place and Mr Darley spoke of the defibrillators. Well worth

going to. National Parks:- nothing to report. On 18th June 2015 the Pott Ash committee report will be live on the website.

Sheepwash hold meetings ‘Problem Solvers Group’ regularly and it would be beneficial for the Parish Council to have a representative there. Next meeting 17th September 2015.

A complaint had been received regarding stiles in Swainby not being dog-friendly. Councillor Hugill will look into the possibility of the NYMNP Community Grant being applied for to be used for this issue.
