MINUTES OF A MEETING HELD AT SWAINBY VILLAGE HALL, SWAINBYON WEDNESDAY 17 JULY 2013 AT 7.30PM

13/105 APOLOGIES FOR ABSENCE & DECLARATIONS OF INTERESTS

There were apologies from Councillor Wilson.

13/106 MINUTES OF THE MEETING HELD ON 19 JUNE 2013

The minutes were agreed and signed as a correct record.

13/107 PUBLIC FORUM

There were no members of the public present.

13/108 CLERK’S REPORT & MATTERS ARISING

  1. A works order had been raised by NYCC to mend the broken beck side fence.

  2. The blocked gulley in Black Horse Lane had been jetted.

  3. NYCC had confirmed that there was no date for the repair of the stone bridge.

  4. Councillor Griffiths confirmed that there were no funds to introduce a 20mph zone in the village.

  5. An inspection of the village had taken place before the meeting with Helen Baxter from NYCC and Clive Thornton from Hambleton DC to look at all the flooding issues. The Clerk would send notes to Helen on each matter.

  6. The Chairman would complete and send off the form regarding the green lane consultation.

13/109 PLANNING APPLICATIONS FOR CONSIDERATION

NYM/2013/0388/NM – Application for non material minor amendment to planning approval NYM/2009/0338/FL to allow the insertion of 2 no. rooflights to front elevation at Hazel Grove Farm, Faceby for Mrs Gillian Hugill. No Objections but concern was expressed at the increasing size of properties in the parish. This is detrimental to the housing mix available.

13/110 PLANNING DECISIONS & APPEALS - HAMBLETON DC & NYMNPA

None received.

13/111 HANDOVER OF PLAYING FIELD

Mick Hannon was not present to discuss the financial implications. The item was adjourned until the next meeting. The Clerk would ask Mick for three years audited accounts.

13/112 PART NIGHT LIGHTING

The plans by Hambleton DC and NYCC to turn off the street lighting between 12am and 5am was supported by the Council.

13/113 POLICE REPORT

The two police officers had attended at 7pm and left a report which the Clerk read out.

13/114 FINANCIAL MATTERS

  1. A list of the payments authorised is attached.

  2. The Treasurer reported the bank balances and discussed the £1,000 fee being asked by Punch Taverns regarding the transfer of the playing fields lease.

13/116 COUNTY COUNCILLOR REPORT

County Councillor Griffiths reported that in addition to the £93,000,000 savings that had to be made in the next 5 years, an additional £11,000,000 would now need to be cut. This could mean a 25% reduction in public transport, nothing was known about how this would affect the bus service in the village. Ringways, the contractor responsible for pot hole repair had been held to account for performance and would be reporting back in six months’ time. It was important to report all pot holes direct to the County.

13/117 DISTRICT COUNCILLOR REPORT

Councillor Hugill had been to the event on the playing field on Saturday. There had been a lot of younger families present. He would be attending the next Sheep wash problem solving group.

The broken beck fence had been reported to NYCC Highways but had still not been repaired. Clerk to chase this up.

The pot hole outside Plum Tree Cottage had been marked for repair along with those between Potto and Scugdale.

County Councillor Griffiths was investigating the provision of a 20mph zone in the village.

The blocked gulley in Black Horse Lane should be jetted by the end of the week. The Clerk would check with NYCC Highways.

The walk around the village with Helen Baxter, the emergency planning officer from NYCC was still to be arranged. Clerk to follow this up.

A request had been received from the organisers of the Coast to Coast Adventure Race to open the public toilets between 6am and 8.30am on 26 August 2013. This was agreed and a contribution would be asked for.

13/93 HANDOVER OF PLAYING FIELD

Mick Hannon detailed the proposed handover arrangements. A report had previously been circulated to all members. He thanked Lisa Wilson from Hambleton DC for helping with a

£10,000 lottery bid and finding £4,000 of additional funding. The following actions were agreed:-

    1. That Whorlton Parish Council agrees to terminate the Sub-Lease with S.P.F.A. dated 4th March 1999

    2. That Whorlton Parish Council agrees to take full responsibility for the development, management and maintenance of the facility (see paragraph 2.1 below) as sole corporate trustee.

    3. That Whorlton Parish Council recognises the support group The Friends of S.P.F.A. and establishes terms of reference for such a group to work within which shall include the delegated responsibilities outlined in paragraph 2.2 below.

    4. That Whorlton Parish Council agrees to respond to Punch Taverns Ltd.’s offer to S.P.F.A’s Trustees to extend the lease relating to the first 30 metres of the site.

Mick Hannon would pursue Punch Taverns to arrange for the lease to be extended and transferred. Rosemary Young, a solicitor with SPFA would resolve the legal matters regarding the Land Registry and the Charity Commissioners.

The Clerk would find out from the Council’s insurers the costs of adding the playing fields to the Council’s insurance. Mick Hannon agreed to discuss with Bill Graham the most suitable accounting processes for dealing with SPFA expenses.

13/94 POLICE REPORT

A report had been circulated from PC Skelton. The Clerk would ask whether this could be put on the noticeboard.

13/95 RAISDALE TO SCUGDALE GREEN LANE

A consultation document had been received regarding the above lane known as Mill Lane. The Chairman would complete this and return it to the next meeting for agreement.

13/96 WINTER WEATHER AGENTS

The Rural Action Yorkshire Winter Weather Agents toolkit would be given to the Emergency Planning group when formed.

13/97 MINERALS & WASTE JOINT PLAN

It was agreed that there were no comments on the joint NYCC, NYMNPA, CYC consultation. A notice would be put on the notice board.

13/98 FINANCIAL MATTERS

  1. Receipts and payments, bank balances and budget vs. actual were all noted.

  2. A list of the payments authorised is attached.

  3. The accounts for the year ended 31 March 2013 were agreed.

  4. The accounting statements for 2012/13 were confirmed.

  5. The annual governance statement for 2012/13 were approved.

13/101 DISTRICT COUNCILLOR REPORT

Councillor Hugill reported that the NYMNPA Community Forum would take place on 9 October 2013 in Pickering.

The lady who had a bicycle accident on the A172 was doing a recreation of her journey for charity. She had raised £3,000 for the Air Ambulance. This would take place on Friday at 6.30pm and it was hoped residents would come out to cheer her on.

NYMNPA had received some funding to improve the cycle routes into the Park from other areas such as Teesside.

SCUGDALE HIGHWAY

 

It was agreed that Councillor Swainson would send the drafted response below to the Clerk

to forward to NYCC.

Gate 1.

This was a long standing feature until approximately 10 years ago when the tenant at the

time put up a fence along the NW side of the green lane. As the small patch of land SE of the green lane has mostly not been in use, the gate has been left open most of the time and may have been missing some of the time.

Gate 2.

This gate is new. Gate 3.

This gate is a long standing feature.

Comment:

  1. The configuration of the fences in the vicinity has changed over the years. At present there is a River Authority funded fence running along the N side of the beck. Part of the purpose of the fence is to reduce sedimentation caused by livestock trampling the banks of the beck. The fence can't fulfill this function without a gate at position 2.

  2. The users of the green lane are leisure users and the tenant of Raikes farm who needs to use it infrequently for transfering stock to and from his land near Harfa House. For both types of user, opening and closing an additional gate is a quite minor inconvenience. Further west along the green lane, gates have appeared and disappeared over the years without causing any problem, and presumably without any gating orders. The important point is that the green lane should remain unobstructed and the gates shouldn't be locked.

The new National Park Authority Community Grant was noted.

13/80 FINANCIAL MATTERS

  1. The attached payments were agreed.

  2. The receipt of the half yearly precept of £4,700 was noted.

  3. It was agreed that the insurance be renewed through Community Consultation Ltd and that the cover be changed to ‘Impact Only’ for the bus shelter.

  4. It was agreed that the Treasurer would produce details of the toilet expenses for the noticeboard.
