16/83. VILLAGE SHOP
Cllr. Hannon reported as follows:
Questionnaire distributed to 250 homes of which 57 replies had been returned. 30 would join a team of volunteers and 36 said yes to investing financially.
Discussion took place regarding the Change of use planning application to be considered by the Planning Committee meeting on 21.04.16
RESOLVED: Parish Council to send an email to Mrs. Hilary Saunders, Planning Team Leader to request a further deferment.

16/86. PARISH COUNCIL INSURANCE RENEWAL
Full details of Hiscox quotation had been circulated. Details of renewal costs of current Insurance policy had been circulated. Details of the £60 charge to end current 3 year agreement had been circulated.
Cllr. Wright proposed to accept the Hiscox quotation. Seconded by Cllr. Brisley.
RESOLVED: To cancel current agreement and accept the Hiscox quotation.

16/87. TREES OVERGROWN
Cllr. Hannon reported this matter within the Parish Assembly: - Asset management register Owners of land with trees are responsible for them. Public safety liability - particularly along river bank where people sit and children play. Ours are at age requiring regular monitoring for risk, NYMNP ranger helping us set up a monitor and record system to demonstrate we are meeting obligations: twice yearly survey.

16/88. EMERGENCY PLAN
Cllr. Hannon reported: - only the Matrix to be completed. Volunteers asked for from the members of the Public, who responded and the chart was completed with names/contact numbers.

16/89. DEFIBRILLATOR
Cllr. Hannon reported this matter within the Parish Assembly: - Defibrillator finally arrived, discussing installation with Village Hall committee. Condition that we hold training session for residents to know how to use it – thanks to Cllr Griffiths for grant to cover the cost of bringing in Ambulance Service for this APPEAL – evening training session when advertised in next couple months

16/90. PARISH COUNCIL RISK ASSESSMENT
Cllr. Wilson had now finalised the Beck & Playing Field Sections. Cllr. Hannon requested two changes be made to the Playing Field Section. As Cllr. Wilson was not present, review of the Risk Assessment to be put onto the agenda for the May meeting.

SPFA had sent Full Council a copy of the notes from their April meeting and a financial report.

                A member of the public requested that they could be allowed to speak through the Chair during Item 3.

               

3.            VILLAGE SHOP

                Cllr Hannon reported that the Planning Committee, NYMNPA on 17 March 2016 had deferred application no NYM/2015/0893/CU in order that: -  'The Authority seek an                                        independent valuation, and the Parish Council pursue the option of a community intervention'.

                Lengthy discussion took place of the options available to maintain a Village Shop for Swainby.  Members of the public, through the Chair gave their views, ideas and                                         suggestions.  It was agreed by all that a strong commitment was required by a community group, if the village was to have a Community Shop.  Cllr. Brisley proposed and Cllr                         Hannon seconded that a questionnaire be distributed to ascertain the interest in offering time or financial investment to set up and run a Community Shop.

                RESOLVED:

                That the Parish Council would distribute a questionnaire to all households as per the proposal of Cllr. Brisley.

                Cllr Hugill suggested Cllr. Cookman, who had been involved with the changeover of Barker's Shop in Huby to a Community Shop, may be willing to come and give advice.  Cllr. Hugill                 would speak to Cllr. Cookman.

                Cllr. Griffiths suggested Adele Wilson, the Stronger Communities Delivery Manager of Hambleton District Council, may be able to offer support.  He also suggested Nicky Smith of the                 Northallerton VSA may have information relating to grants available.

                RESOLVED:

                That the Parish Council would invite Adele Wilson to come to the Parish Assembly meeting to give advice and support.

16/29. TO ELECT A VICE CHAIRMAN
Deferred to the next meeting when full council are present.

16/30. PUBLIC FORUM
The applicant for planning application NYM/2015/0719/FL (Item 10) was present and
was here to discuss any concerns the Parish Council may have in relation to the amended plans for this
application. Full Council confirmed they had NO OBJECTIONS and would leave matters to the Planning Officer.

16/31. MATTERS ARISING FROM THE MINUTES
None.
16/32. GOVERNMENT FUNDING FOR PARISH COUNCIL WEBSITES
Cllr. Wilson gave an account of the application he had made to the YLCA for funds to Build, Maintain and administer a new Parish Council Website. The total funds applied for would maintain/administer the site for a full year. Parish Council would review the maintenance/administration at the end of that initial years' service.

16/33. CLERKS REPORT
a) Council advised of free access to the Public Sector Mapping Service. Clerk to email link to the site and membership number/password to all Councilor's.
b) Update regarding the Biodiversity report from Mr Kenneth Lee and passed to Mark Antcliffe, Woodland Officer of NYMNPA given. Cllr. Hannon confirmed she had spoken to Highways as this was area was not in the conservation area. Clerk will advise Mr Lee and has left this matter with the Parish Council.
c) 2nd Key holder for Notice Board required and Cllr. Brisley agreed to take responsibility for administering the Notice Board in the absence of Cllr. Hannon.
d) Council reminded Clerk will be away between 20th February and 27th February. Noted.
e) Council advised of HDC Parish Liaison meeting on 31st March 2016. Noted.
f) Clerk advised Returning Officer had confirmed no response to the election process and the Parish Council should now begin the Co-option process. Clerk had produced an advertisement for the Vacancy. Chairman to
display advert on the Notice Board. Cllr. Hannon asked Council for the names of anyone they felt would be interested in putting themselves forward as a Councillor. Cllr Wilson and Brisley had no suggestions at this time.

16/34. DEBFIBRILLATOR
Cllr. Hannon confirmed the defibrillator had not yet arrived.
Clerk advised the application to Cllr. Griffiths Locality Budget was successful and a grant of £300 had been made
towards the cost of Familiarisation Training sessions. Forms signed by two Parish Councillor's to release the funds to Parish Council Bank Account.

16/35. BECKSIDE FENCING
Cllr. Hannon confirmed any permissions required to commence work had now been received. The logistics now needed to be discussed. Both sides of the fencing need to be taken down except for the safety areas, which had been specified by Highways. The fencing at the 'Village Hall' side of the beck would not be replaced and the opposite Side of the beck would be replaced with bollards approximately 2 metre's apart. (260 metre's in total). At both ends the bollards would be closer declining and curved. Cllr. Wilson stated he had thought Bird Mouth Fencing was to be used and that the fencing at the Village Hall side was still pretty good. Cllr Hannon stated that was not what had been discussed following the appraisal. No quotation had yet been obtained, however Cllr Hannon had made some initial enquires and felt the total cost would be approximately £6,500. Parish Council held enough reserves to complete half of the work and quotations would now be obtained. Cllr Hannon would also investigate the possibility of any available grants.

Cllr. Hannon suggested the work could be carried out over a weekend with the help of volunteers from the village. Cllr Brisley to put in place a plan and advise Cllr Hannon when the work could be carried out in order that she could apply for the Street Works Notice and the Traffic Management Plan.

Cllr. Hannon suggested the wood could be offered for sale/donation if cut up as it was taken down, and be used for wood burners. A tarpaulin may be needed to cover the wood.

Cllr. Wilson and Brisley will take a look at the fencing to ascertain how easy it will be to remove and then give a timescale for the work by Mid-March, in order that supplies can be ordered ready for April. Cllr Hannon will speak to the Rangers for advice/help they can offer.

16/47. COUNTY COUNCILLOR REPORT
NYCC recommending a 1.99% rise in Council Tax, plus the 2% Social Care allowed by Government.
Cllr. Griffiths does appreciate there have been many cuts and this has been difficult.

16/48.   DISTRICT COUNCILLOR REPORT

                The new re-cycling bins have been rolled out and first collections start w/commencing 29th February.

                It is appreciated there may be some issues regarding space to store this new bin, however there has been calls

                for cardboard to be recycled and this will help.

                Council Tax will be going up by £5 as per Band D.  HDC still the 3rd lowest in the country.  All of their front line  services are still in place.  Cllr. Hugill feels it can be justified.

                Cllr. Hannon had attended the Hambleton Consultation and this was the first stage of writing the plan.

16/01   APOLOGIES FOR ABSENCE & DECLARATIONS OF INTERESTS

16/02   TO AGREE MINUTES OF THE MEETING HELD ON 18th NOVEMBER 2015

The minutes had been circulated and were agreed and signed by the Chairman as a true record.

16/03   RESIGNATION OF VICE CHAIRMAN

            The resignation of the Vice Chairman Simon Foster was recorded. Cllr. Hannon expressed

the Parish Council’s appreciation and thanks to Simon for his hard work on behalf of the Parish.

16/04   ELECTION OF A VICE CHAIRMAN

This election will be carried forward to the February meeting when full council will be present.

            16/05 PUBLIC OPEN FORUM

A member of the public spoke of the planning application at Item 11. Village Store. He felt it was sad if the village loses the shop and he wonders how rigorously the marketing has been to find a buyer to take over the business. The shop owner was present and he confirmed the shop had been marketed. Cllr. Hannon thanked Chris and Liz the owners for their work in providing the village with a shop, however she confirmed the Parish Council were concerned about the loss of the shop, particularly for the more vulnerable villagers.

The shop owner stated that locals were not using the shop enough. Cllr. Brisley asked about the takings from the Coffee Shop and the owner said the takings were very little. Cllr. Brisley also asked how much income was lost from the loss of the Post Office and the owner confirmed that loss had been £14,000.   Cllr. Wilson confirmed that the village would like to keep it open. Cllr Hannon stated that the Parish Council will explore options for the village to have a shop.

A member of the public stated that he felt there must have been expressions of interest.

The shop owner confirmed that the shop will close.

Cllr. Hannon confirmed that the Parish Council would be objecting to the Planning Application for the change of use of the Village Store.

A Member of the Public asked Cllr. Hannon if she had received a reply from the Village Hall Committee regarding the Defibrillator. Cllr. Hannon confirmed agreement had still to be made regarding the siting of the Defibrillator.

16/06 MATTERS ARISING FROM THE MINUTES.

There were no matters arising from the minutes.

            16/07   GOVERNMENT FUNDING FOR PARISH COUNCIL WEBSITES

The Clerk will send Cllr. Wilson information regarding website designers for Parish Council sites and a link to a Parish Council site built by Nigel Knapton. Clerk to obtain application form from the YLCA and await Cllr. Wilsons report.

16/08   CLERKS REPORT

  1. Clerk updated the Council on the review/changes required for the Swainby Public, Open Space, Sport & Recreation Action Plan. Parish Councillors to consider possible projects to be included within the Plan.
  2. Clerk updated the Council regarding NYCC plans for a Parish Portal.
  3. c)YLCA subscription increase of £12.38 for the financial year 2016/17 was noted.
  4. Cllr Hannon confirmed she will attend the Hambleton Local Plan Consultation on 21.01.16.
  5. The Queens 90th Birthday Beacon Celebrations were noted and a member of the public confirmed that Swainby already has a Beacon.
  6. f)A late addition to the agenda was the receipt of NYCC Highways proposed siting of Playground signs. Two signs were proposed and the positions had been sent for Parish Council approval. Full Council agreed to the proposal.

16/09   DEFIBRILLATOR

Cllr. Hannon confirmed the Defibrillator had not yet arrived. Discussions with the Village Hall Committee were taking place to confirm the siting of the Defibrillator.

Clerk gave details of the governance requirements, including the need for a guardian to carry out weekly checks. A file containing the governance documentation was currently work in progress. Familiarisation/Training sessions would be needed and Cllr. Griffiths confirmed the Parish Council could apply for funds from his Locality Budget. Cllr. Griffiths left a form for the Clerk to complete and return.

16/10   BECKSIDE FENCING

Cllr. Hannon (accompanied by Cllr. Foster) gave a report of her meeting with Area2/Highways regarding the Parish Council Appraisal of the Beckside Fencing. Highways had recommended that photographs be taken as evidence of repairs required before the removal of any fencing. Risk Areas must be retained/replaced. Birdmouth Fencing would be used. No financial aid was available, however there was potential for materials. A member of the public recommended a company by the name of Rembit. Parish Council will begin to source materials. Simon Foster had confirmed the next meeting would be in 2 weeks’ time and a further update would be sent following the meeting.

Fracking: Chair of Planning had met with Kevin Hollinrake MP regarding a proposal for a buffer zone around the National Park.

Buffer zone also needed to prevent housing development. 

16/24   PARISH COUNCILLORS REPORT

Short discussion took place regarding the village store. Cllr Brisley to visit other village stores for information building purposes.

Parish Council to consider holding meetings on a Bi-monthly basis at the February meeting.
